1. Acceptance of Terms
By accessing or using UpScale.build, you agree to be bound by these terms. If you are using the platform on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
2. Service Description
UpScale.build is a cloud-based construction project management platform. We provide tools for feasibility analysis, progress claims, variations, site diaries, tenders, and other project management functions. The platform is provided “as is” and we make no guarantees about uptime or availability.
3. Account Responsibilities
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
4. Data Ownership
You retain ownership of all data you enter into UpScale.build. We do not claim any intellectual property rights over your project data. You grant us a limited licence to store, process, and display your data solely for the purpose of providing the service.
5. Pricing and Payment
Current pricing is displayed on our website. We reserve the right to change pricing with 30 days' notice. Free tier accounts have no time limit but are limited to one project and one team member.
6. Acceptable Use
You agree not to use the platform for any unlawful purpose, to attempt to gain unauthorised access to other accounts, or to interfere with the proper operation of the service.
7. Limitation of Liability
To the maximum extent permitted by Australian law, UpScale.build shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
8. Termination
Either party may terminate this agreement at any time. Upon termination, you may export your data within 30 days, after which we will delete it in accordance with our privacy policy.
9. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
